A construction worker and father of three who was arrested after not paying to ride a train in a New York subway station has won $250,000 (£169,790) in a settlement after he sued for police brutality.
Kalween Rodriguez took action after suffering a fractured cheekbone during the altercation with police officer Massood Syed, which took place in January 2009.
Mr Rodriguez needed surgery, but everything else about the violent incident in the Sutter Avenue station remains in dispute.

The New York city Law Department said the settlement was in the best interest of all parties.
New York Police Department spokesman Paul Browne said Mr Rodriguez was arrested after trying to enter the turnstile gate without paying and attacked the officer.
The Brooklyn district attorney's office dropped all criminal charges against Mr Rodriguez, however, and Mr Syed was neither suspended nor disciplined.
'I don't want to say anything that might affect my case,' Rodriguez said in a brief phone interview with the New York Daily Post.
His sister, Vanessa Rodriguez, acknowledged yesterday that her brother was asking other people for money to take the train.
But she said he was given permission to go through the gate by a New York City Transit employee.
Police said Mr Rodriguez was aggressively harassing other passengers when Mr Syed ordered him to leave the station and he refused.
'While being placed under arrest, Rodriguez attacked the officer,' Mr Browne said in a statement.
'After a four- or five-minute altercation the officer was able to handcuff him. Both were later taken to the hospital.'
Rodriguez was screaming obscenities and invited witnesses to join in assaulting Mr Syed while yelling: 'He's not a cop. Everyone f*** him up,' according to the Mr Syed's account in court papers.
Rodriguez's lawyer declined to comment on the suit, which was filed earlier this year.
